1. The story starts at Flag A. It develops into two aspects: production of the documents 'on discovery' and by possible subpoena on the Secretary of State. The position on the former appears to rest with Flag E and Flag F. We have been involved in the latter aspect but this has only been pursued on a contingency basis as advanced preparation in case a subpoena is served on the Secretary of State. We now have the Hong Kong Crown Solicitor's re-considered views on the categories into which the documents fall. It is up to us to pass these to
the Treasury Solicitor and I think it would be appropriate for us to ask for his comments. I think we might also ask if he has heard of any further developments in the case, since he gave us a progress report in his letter to you of 26 August 1981 (Flag H) and also mentioned in his letter of 17 July 1981 (Flag F) that he would keep the Attorney-General informed of any development in the case.

see his would appear to be up to the Attorney-General to do - Office's letter of 15 June 1981 to PS/Mr Blaker at MOD (Flag B). Also, as you can see from Flag E, there is direct contact between the Treasury Solicitor and Mr Blaker's Legal Advisers.
3. I suggest therefore that the final sentence of your letter of 15 January to Mr Bailey could read 'I should be grateful for your comments and to know if you have heard of any further developments in the case.
