Some local legislation must be approved in the UK both in draft form and after enactment.

Royal Instructions, Proclamations and Charters (para 8.4)

Constitutional Instruments (para 8.5 and Chapter 6)

SUBMISSION OF LOCAL LEGISLATION TO FCO

The Officer Administering the Government (OAG) submits local legislation to the FCO in the manner prescribed in Colonial Regulation No 149. A covering report by the OAG or his Attorney- General is required.

On receipt in the FCO, action is as follows

September 1980

Documents are registered by the appropriate registry and sent to the desk officer

Desk officer sends the file to the Commonwealth legal section of the Library which takes the necessary action (para 8.2.3) and returns the file to the desk officer

Desk officer decides whether the advice of other Departments or Advisers is required and if it is obtains it (para 8.2.4)

Desk officer checks that Colonial Regulation No 149 has been complied with and that the material is complete (para 8.2.5)

Desk officer sends papers to the Department Legal Adviser (para 8.2.6 and 8.2.7)
