PQ HONG KONG MS CHRISTINE VERTUCCI
I submit draft replies to 6 PQs by Mr Robert Parry MP for
1.
priority written answer on 2 Febraury.
The replies are based
on drafts provided by the Hong Kong Government.
2. The background to Ms Vertucci's case is contained in
Hong Kong Telegram No 72. I recommend that we support the
Hong Kong Government's action.
3. The authority for Hong Kong's action is provided in their
Immigration Ordinance. Any person without the right to land in
Hong Kong, which Ms Vertucci as an American citizen does not have,
needs the permission of an immigration officer to enter or remain
in Hong Kong. Permission to remain may be for a specified period
which may be curtailed only by the Governor. When that period
expires, and if it has not been extended, the person is required
to leave. He is however entitled to appeal to the Governor in
Council. If a person appeals, as Ms Vertucci is expected to,
it is usual to allow him to remain until the Governor in Council,
that is the Executive Council, has ruled on the appeal.
