(807 When Lord Shepherd called on Lord Belstead on 5 October, he

raised the case of Mr Fung King-hey, a leading Hong Kong business-

man, and asked if Mr Fung could have an assurance from HMG that he

could take up residence in the United Kingdom if things were to go

wrong in Hong Kong. Lord Belstead explained that this was a matter

for the Home Office and that there were certain arrangements laid

down for entry into this country which might be applicable to

Mr Fung, and undertook to write to Lord Shepherd in due course.

RECOMMENDATION

2. I recommend that Lord Belstead speak to Lord Shepherd on the

lines of the attached note. MVD and NTD agree.

BACKGROUND AND ARGUMENT

Mr Fung was born in China in 1922, and is now, as Chairman

and Managing Director of Sua Hung Kai Securities Limited, one of

the leading (and probably richest) businessmen in Hong Kong. As

such, he would not be able to claim British citizenship when the

British Nationality Act comes into effect on 1 January 1983, but

may qualify for entry under the Immigration Rules as a businessman

or a person of independent means.
