The purpose of this memorandum is to seek the advice of Members whether the Immigration (Amendment) (No 2) Bill 1982 at Annex A should be introduced into the Legislative Council. The Bill seeks to make consequential amendments to the Immigration Ordinance stemming from the British Nationality Act 1981 (BNA 1981).

The advice of Council is also sought whether, under section 59 of the Immigration Ordinance, the Immigration (Amendment) Regulations 1982, at Annex B should be approved in principle. The Regulations seek to make a consequential amendment stemming from the BNA 1981 and to update a list of documents issued by the Director of Immigration.

British Nationality Act 1981

The BNA 1981, which will come into force on 1 January 1983, replaces the present citizenship of the United Kingdom and Colonies (CUKC) by three separate citizenships, that is,

(a)

British Dependent Territories Citizenship (BDTC) for people connected with the British Dependent Territories;

(b)

British Citizenship (BC) for people connected with the United Kingdom, the Channel Islands and the Isle of Man; and

(c)

British Overseas Citizenship (BOC) for those CUKCS who do not acquire either of the other citizenships.

Entitlement to BDTC as at 1 January 1983

Under the BNA 1981 and on 1 January 1983, BDTC will

be acquired automatically by existing CUKCS
