approach to be adopted in the transitional provisions. This has been agreed
with Legal Adviser's Branch. The transitional provisions on this occasion do not present the same difficulties as last time, because the main change
on husbands is a relaxation. Where stricter requirements would be introduced
as regards the new monetary limits for businessmen and others
the new
Rules would not bike on people who had been admitted under the present Rules
(HC 394).
Drafting changes

19. As indicated, it could be necessary to make some minor modifications in paragraphs 24 and 97 on students. The transitional paragraphs have also to be
finalised. The changes in the draft White Paper have for the most part been
agreed by Legal Adviser's Branch, but it is possible that we could need
to make some other drafting changes.
Next Steps
20. The Home and Social Affairs Committee have agreed the revisions on husbands
and fiances, which are the only controversial changes. Other changes on
children born here, nationals of European Community countries and returning
residents were referred to in general terms in the memorandum approved by
the Committee at that meeting. In the circumstances it seems appropriate to
invite Members of the Committee to clear the text of the draft White Paper in
-ing correspondence, subject to any draft/changes which may be necessary. will be needed by early September to meet a publication date in the week beginning 18 October. The White Paper would be cleared with the Cabinet when
a printed set of the Rules is available, very shortly before publication. A
draft letter is attached for S. of S. to send to Members of the Committee, if
approved.

Handling of immigration matters:
(i) Rayner scrutiny of the Work Permit System
The Secretary of State for Employment has asked whether S. of S. would wish him to defer publishing the report of this scrutiny until the White Paper
on the Immigration Rules has been published. Otherwise he would not wish to
defer publication needlessly. Now that it has been decided not to accept the
Rayner recommendations on working holidaymakers and dependants of students and work permit holders no amendment to the Rules (other than the very minor
ones mentioned in paragraph 14 above) will be required as a result of this
scrutiny. We think that there is much to be said for early publication of the Rayner scrutiny so that the issues raised by the report can be disposed of before the White Paper is published, and in a context where they will be seen
