The British Nationality (Miscellaneous Provisions)

Ordinance provides for offences and fees in Hong Kong relating to the provisions of the British Nationality Act 1943 (BNA 1948).

The British Nationality Act 1981 (BNA 1981) will generally replace the BNA 1948 and other subsequent British Nationality Acts and will introduce new definitions of, and qualifications for, citizenship with effect from 1 January 1983. Consideration has, therefore, to be given to the question of appropriate amendments to the Ordinance.

The purpose of this memorandum is to seek the advice. of Members on whether the British Nationality (Miscellaneous Provisions) (Amendment) Bill 1982 at Annex A should be introduced into the Legislative Council.

Explanation of clauses

Clause 3 introduces new definitions which have the effect of specifying that applications for naturalization and registration are applications for British Dependent Territories citizenship under the BNA 1981 (instead of applications for naturalization and registration as a citizen of the United Kingdom and Colonies under the BNA 1948).

Clause 4 provides for the present maximum penalties of -

three months' imprisonment for knowingly or recklessly making a false statement to be altered to three months imprisonment or a fine of $15,000 or both; and

(b) a fine of $1,500 for failing to comply with regulations made with respect to delivering

up naturalization certificates to be increased to $7,500.
