Explanatory Memorandum

The object of this Bill is to amend numerous

Ordinances and instruments to bring them into line with

the new terminology adopted by the British Nationality Act

1981. Accordingly the provisions of the Bill are essentially

consequential to the enactment of the British Nationality Act

1981, which replaces the single concept of "citizenship of

the United Kingdom and Colonies" with a three-fold concept

of "British citizenship", "British Dependent Territories

citizenship" and "British Overseas citizenship"; and

which also replaces references to "British subject" with

references to "Commonwealth citizen" (save in very limited

categories which are not relevant to Hong Kong).

Clause 2 of the Bill and the First Schedule amend

the existing terminology relating to citizenship to be

found in Ordinances.

Clause 3 of the Bill and the Second Schedule

amend the existing terminology relating to citizenship

to be found in rules, orders, regulations and other

instruments.

4.

Clause 4 of the Bill empowers the Governor in

Council to amend the First and Second Schedules.

The enactment of this Bill will not result in

any significant Public Service staffing requirements or

public expenditure.
