Hong Kong Attorney General's paper.

1. Mr Freeland discussed this paper with Mr Griffiths, the Attorney General from Hong Kong, on Friday 13 August. Mr Pakenham-Walsh & Mr Addison of the Home Office, Mr McQuade, Miss Brooks, Mr Rooney and I were also present.

Substance

2. The substance of the discussion is being recorded by Mr Rooney. HKGD will take this as the basis of a telegram for dispatch to Hong Kong during Monday 16 August. Their telegram will be cleared with Mr Freeland.

Management in Whitehall

3. Home Office officials consider that they will have to refer this proposal to Mr Whitelaw. A view concerted with the Home Office at ministerial level will have to be formed not later than mid September before the Prime Minister leaves on her tour of the Far East. Most Ministers are on holiday until the end of August.

4. We agreed with Mr Addison that the best way to handle this might be for an Under Secretary (Mr Donald or Lord N Gordon Lennox) to write to Mrs Littler explaining FCO views and asking them for Home Office comment. The FCO letter and Mrs Littler's reply would both state that they had been seen by Ministers.

If there is considerable divergence in the two Departments' views and this is expected we shall then submit that Mr Pym

6. I shall put up a submission covering a draft letter to Mrs Littler early next week with HKGD's telegram to Hong Kong as Flag A.
