1. The attached draft brief was prepared for use by FCO Ministers in a possible discussion in OD (FAF) on 6 September. The Secretary of State has requested however that there should first be a Ministerial discussion to clear lines within the FCO before approaching OD (FAF). (Mr Holmes' minute of 20 August to PS/Mr Onslow). The attached brief is accordingly submitted as, in the first instance, background to that Minis- terial discussion.

2. The draft has been cleared with SAmD, HKGD, WIAD, SPD, SED, MVD, the Falklands Unit and ECD(I).

3. Mr Whitelaw is expected to enquire about FCO views on his return from leave at the end of August.

4. Home Office officials have already sent us for comment in due course a draft Second Reading speech opposing the Bill. We shall not comment on this until we know our own Ministers' views on the handling of this essentially Parliamentary problem.
