A proposal to approve registration in a case (other than those mentioned in B.4(a) and (b) above) where it is necessary to do all or

any of the things mentioned in B.3(i) (iii) above in order to establich

the entitlement, should be submitted to at least HEO level.

7. A proposal to refuse registration in a case as is mentioned in B.4(a) above and in a case where special circumstances have been given

for the exercise of the discretion to waive all or any of the residence

requirements should be submitted to at least HEO level. Refusal in

other cases may be authorised at EO level.

8. If it is intended to refuse a Gibraltarian, he or she should be

advised of his or her entitlement under section 5 - but worded that

registration under that provision will give British citizenship by

descent.

Miscellaneous

1. Refund of fees

In all cases where registration is not or cannot be approved,

any fee or part of a fee that has been paid will be refunded and

the procedure in T.I.4/81 should be followed.

A list of the stock letters and drafts used in connection with

registration under s.4 is given at [Annex A / elsewhere].

Interpretation

Unless otherwise stated, references in these instructions to

sections and Schedules are references to the British Nationality

Act 1981.
