THE CURRENT AIR SERVICES ARRANGEMENTS DO NOT PROVIDE FOR THE CAPACITY INCREASE (17 PER CENT IN TERMS OF SEATS) PROPOSED BY MAS.

ANNEX B TO THE CMU OF 9 OCTOBER 1979 PROVIDES GUIDELINES TO THE AIRLINES FOR THE PURPOSE OF DETERMINING CAPACITY INCREASES.

THESE REQUIRE THE AIRLINES WISHING TO INCREASE CAPACITY TO DEMONSTRATE THE NEED TO THEIR RESPECTIVE GOVERNMENTS. SO FAR AS WE KNOW, MAS HAVE NOT MADE A CASE AND WE THEREFORE DO NOT ACCEPT THE MAS SUMMER 1982 SCHEDULE.

2. ACCORDING TO CPA, THE GUIDELINES SET OUT IN ANNEX B ARE ANYHOW IMPRACTICABLE, THERE BEING NO PROMOTIONAL FARES BETWEEN HONG KONG AND MALAYSIA (ALTHOUGH OAA FARES ARE PERHAPS RELEVANT). BUT THE FACT IS THAT THE AIR SERVICES ARRANGEMENTS PROVIDE FOR PRE-DETERMINATION OF CAPACITY AND IT IS ENCUMBENT ON THE MALAYSIANS TO MAKE A CASE FOR AN INCREASE. TO SIMPLY FILE A TIMETABLE IS NOT ENOUGH. WE HOPE THAT THIS CAN BE MADE CLEAR TO MAS IN WHICH CASE WE PRESUME THAT THE MALAYSIANS WOULD CALL FOR TALKS AS A MATTER OF URGENCY. IN THIS EVENT, WE WOULD PROVIDE OUR VIEWS IN THE USUAL WAY. AS REQUESTED BY ROBERTS (DOT) DURING HIS RECENT VISIT TO HONG KONG, LATHAM AND MCARTHUR WILL DISCUSS THIS MATTER WITH STEVENS IN THE MARGINS OF THE FORTHCOMING

AIR SERVICES TALKS IN COLOMBO AND PROVIDE DETAILED FIGURES.
