the obligations already undertaken by the State
concerned under global and regional instruments
on human rights;
the human rights protected under the legal
systems of the State concerned;

whether the situation before the Committee was
already under investigation by other competent
international bodies;
(iv)
whether available domestic remedies had been
exhausted or their application unreasonably
prolonged;
(v) whether there was provision for derogation from
certain rights in time of emergency in accord-
ance with the international obligations of the
State concerned.
17.
We further recommend that Heads of Government could
entrust to the Committee such additional functions of con-
ciliation or good offices as they consider appropriate in
special circumstances.
18.
We wish to stress that the proposed Commonwealth
Advisory Committee on Human Rights would not duplicate the work of other global or regional bodies in the field of human rights. The Committee would not be empowered to consider any communication submitted by an individual claiming that he or she was the victim of a violation of human rights,
except to the extent that that communication tended to reveal
