STS 347/01

"Spaniards

Dual nationality agreement between Spain and Peru. Art 1: and Peruvians may acquire Peruvian or Spanish nationality without losing their previous nationality. Persons who have acquired Spanish or Peruvian nationality by naturalisation may not avail themselves of the provisions of this agreement". This is a variation of the origin clause in Art 1 of the Spanish-Chilean agreement.

Annex 3.

Dual nationality agreement between Spain and Paraguay. No reference in Art 4 to status in third countries. There is also no reference to persons who have not registered change of domicile etc who may, under Spanish-Chilean and Spanish-Peruvian agreements, move to and work in the other country.

Annex 4.

Art 1,

G

Dual nationality agreement between Spain and Nicaragua. second paragraph: "persons who have acquired Spanish or Nicaraguan nationality by naturalisation may not avail themselves of the provis ions of this agreement". Under Art. 4, second paragraph, change of usual place of residence from one contracting country to the other "will imply change of domicile, and consequently of nationality", This is stronger than in agreements 1-3, which say that "domicile may only be changed in the case of transfer of usual place of residence to the other contracting country".

Annex 5

Dual nationality agreement between Spain and Guatemala. The title does not specifically refer to dual nationality and Recital 2 talks of the option of "recovery" but not of "retention" of the original nationality. This does not strictly speaking constitute dual nationality but only the right to adopt whichever nationality may be required at a given time and to return to the former nationality if desired. Similarly, under Art. 1 nationals of either country may acquire the nationality of the other country by establishing domicile, but the usual phrase "without losing their former nationality" (See agreements 1-4) is not included. However, Arts. 2-5, though differently
