It is understood that UK crew and HKC crew contracts and terms

of employment are different. What are the differences and why do they exist?

The main difference in the articles of agreement signed by HKC and UK Seafarers in terms of the current operation is that for UK Seafarers it is a requirement under the National Maritime Board agreement that, in the event of operations of a war-like nature, seafarers shall be given the opportunity to terminate their engagement if facilities for repatriation exist at a scheduled port of call. No such agreement applies to HKC Seafarers. Of course, it should be noted that the relevant agreements differ in other respects and derive from different negotiating processes. It should be remembered that all agreements are freely entered into by both sides. (The terms of employment offered to HKC Personnel in the RFA are broadly similar to those offered to other HKC Seafarers whilst the terms of employment offered to UK crews are in line with NMB Agreements).

Were the crew given the opportunity to leave the ship if they wished as other Merchant Navy personnel were?

No.

There was no need to do so under their terms of employment which they had willingly entered into7.

Is it true to say that HKC crew members refused duty during the Falklands Operation and that they were threatened if they did not cooperate?

The Landing Ships Logistic were involved in a particularly difficult task and, in common with all other personnel involved, the HKC were naturally concerned with the possible hazards. Of course, all members of the Task Force came under the terms of the Raval Discipline Act following the declaration of active service and this required them to give their full
