Members of Council in tendering advice when consulted pursuant to Article XXXIV are not of course bound by the views expressed in the Chief Secretary's speech, but no doubt would bear its terms in mind. The legal duty of members is to consider each individual case on its own facts and merits and to advise thereon as they feel to be appropriate in all the circumstances.

At Annex B, for the information of Members, is a list of prisoners sentenced to death since January 1976, showing the date of commutation and the commuted sentence, together with a very brief description of the nature of the crime.
