BRITISH NATIONALITY ACT 1981: CROWN SERVICE

Section 2 of the BNA 1981 as read with section 14 provides that a person born overseas shall be a British citizen otherwise than by descent (such a person will in turn transmit British citizenship to his or her overseas-born children) if -

(a) his parent was a British citizen, and

(b)

(c)

that parent was in Crown service under the government of the UK, and

that parent was recruited in the UK.

Section 2 also provides that the Secretary of State (the Home Secretary) can designate certain other types of service so that the overseas-born child of a person in such service is treated in the same way as the Crown Servant's child. Our candidates for designation are the British Council, HMOCS, HMOJ, governors of dependent territories (not all of whom will be HMOCS or Crown servants) and NATO. The Home Office are about to draft a Statutory Instrument to cover our candidates and as you will see from the attached copy of a letter dated 9 June from Mr Addison the Home Office are asking for definitions of our candidates. I should be grateful if you would let me have such definitions (by telephone if necessary) of the bodies for which you are responsible by 17 June.
