11 Compensation Limits

Article C of the Brussels Protocol amends the Article 3 of
the Brussels Convention by providing for compensation of up to
300 million SDRs per incident in place of 120 million units of account. The scheme of Article 3 (as it is to be amended) provides for at least the first 5 million SDRS of this compensation to come from funds provided by the operator's insurance or other financial security. Between this amount and 175 million SDRs (formerly 70 million i units of account) compensation from public funds shall be made available by the contracting state in whose territory the nuclear installation of the operator liable is situated. Between 175 million and 300 million SDRS compensation is to be provided by Contracting States according to a formula for contributions set out in Article 12 of the Convention.
21. The United Kingdom has adopted the second alternative means of implementing the Brussels Convention allowed by Article 3(c). This is reflected in section 18(1). The Brussels Convention as it is now in force does not contain any provision: similar to Article 7(b) of the Paris Convention which allows conversion into national currency in round figures. Indeed, it appears to contain no provision at all about conversion. Article 3(g) defines the expression "units of account" as "the unit of account of the European Monetary Agreement as defined at the date of the Paris Convention." Article 1 of the Brussels Convention states that it is supplementary to the Paris Convention and, as noted above, it seems that the UK has previously taken the line that the Paris Convention provision about converting in round figures should apply
