1. I have no comments on the revised draft as it stands but I wonder if it quite answers the main point put to Mr Marten by the TCI Government. That Government presumably the Ministers asked for 'the chance to comment on the candidates proposed for the impending appointments of Governor and Attorney-General before they are publicly announced'. I should think that what the Ministers really want is to be consulted before the candidate is appointed.

2. I suggest therefore that para 2 of the draft should include a sentence to the effect that there is no legal or constitutional objection to the Governor consulting the local Government, to the extent which he may deem appropriate, before an appointment is made to the office of Attorney-General. This however must be left to the Governor's discretion and no official undertaking can be given in this regard. In para 3, on the Governor's appointment, I assume you will simply say that there is no question of any local consultation.
