It appearing to the Governor in Council that the terms of
reference set out in the Gazette of 9th July 1980 under the heading "Appointment of Commission of Inquiry" in relation to the death of Inspector John MacLennan are very wide and so in need of re-definition; that the reputations of innocent persons unrelated to his death, have been or may be needlessly damaged; that the Inquiry, in consequence
of the uncertainty caused by the present broad terms of reference, is proceeding at a much slower rate than is desirable; and that the public interest requires that certain measures be taken, and bearing in mind the provisions of the Salmon Report (Cmnd. 3121), and in particular Chapter VII thereof, the Governor in Council, pursuant to the powers conferred upon him by the Commissions of Inquiry Ordinance (Cap. 86)
specifies the subject of the Inquiry and directs pursuant to Section 3
of the said Ordinance, where either or each is applicable, as follows:

The terms of reference of the Commission of Inquiry shall
be as follows:
a) Did Inspector MacLennan commit suicide? If not, how
· did he die?
b)
Should the Police in the period between his death and
the cremation of his body, reasonably in all the
prevailing circumstances, have taken any other steps
or conducted any other investigations, and if so what
other steps or investigations, so as the better to have
assisted in ascertaining whether or not his death was
suicide?
c)
Was the evidence against Inspector MacLennan upon
which charges were to be prefered against him on the

day of his death, obtained by the Police by lawful means?
If not, how was such evidence obtained by the Police and
were they motivated by any improper animus against
