ANNEX A

The Council ADVISED and the Governor ORDERED

that a Judicial Inquiry should be appointed. The Governor

tabled draft terms of reference, which were agreed in

principle by the Council subject to such amendments as the Governor might feel to be desirable and to the following

comments and possible amendments.

a) the Attorney General undertook to check the accuracy of the opening statement attributed

to the Coroner;

the second paragraph to be expanded by adding

"and to the fact that CAPO investigations into

some aspects of these allegations have now

been completed";

the third paragraph to be expanded by adding

"making it desirable to establish the circum-

stances surrounding Inspector MacLennan's

death and related issues, and in the public

interest to establish the facts and to clear

innocent parties";

d)

to delete the reference to the Royal Hong Kong

Police Force in sub-paragraphs (b) and (d);

e)

to amend sub-paragraph (e) to read "whether the enquiries under (b), (c) and (d) were

properly motivated and had no ulterior motive";

to arrange, if possible, that the Commission

should have power to punish for contempt if
