refers to the action that Fulton was requested to take in regard to the deceased in thse terms. In his statement of

28.1.80 Fulton states quite clearly that he does'nt consider the SIU were framing the deceased because he has no evidence of this but he does consider that they were over-zealous. The allegation of a frameup is completely denied by the SIU. It is worthy of note that it has been stated by Mr R.L.Brooks that particular care was taken by members of the SIU to ensure that the investigations into the deceased were conducted properly as they did not wish to be accused of a vedetta against the deceased which others may have thought emanated from a grudge against the deceased owing to his reinstatement in 1978. It should also be noted that the SIU. had no dealings whatsoever with the investigation into the allegation against the deceased in Yuen Long and the SIU had not even been set up then. It should also be noted that part of the charter of the SIU is to

investigate members of the Government Service where the chance of a security risk is possible. Far from concentrating on people like the deceased, the SIU have been concentrating very much on the procurers and blackmailers they are also tasked to deal with. Fultons statement of 15th Feb. page 4 bears this out.

Fulton would appear to have been content with the situation after his interview with Mr Clancy and this is corrob- orated by Clare Marie Beeson. He has made a statement to the effect that he does not wish to make a formal complaint against any members of the SIU.

CIRCUMSTANCES SURROUNDING THE SUICIDE

139. From the evidence given it would appear that the deceased took his own life by shooting himself five times in the body with a Police revolver at some time between 0630 and 0730 on 15.1.80. The fact that a suicide note was written by the deceased at 0610 hrs and was found inside the flat and that sharp bangs that could have been shots were heard sometime sfter six o'clock are consistent with this probable theory.

140. All available evidence would indicate that the possibility of foul play including homicide can be ruled iut, having regard

to all the facts including the locked doors and windows, the absence of any signs of struggle and the fact that nothing would appear to have been stolen or damaged. Some characteristics of the Post Mortem and Ballistics report are consistent with someone taking his own life, and the fact that no strangers were seen in the vicinity by the watchman in the early hours of the morning is relevant.
