her. She will further state that during her conversation with the deceased he did not use the term frame-up. He did, however, say that the accusation was untrue.

Mr. Henry Stanislaus Daniell, District Court Judge will state that in 1978 he held the post of Magistrate in Fanling and that one of the Police Prosecutors attached to Fanling Court was the deceased. He will state that sometime in November 1978 the deceased came to him in a desperate state saying that his contract had been terminated because of an enquiry into an allegation of homosexuality in Yuen Long. seemed upset that he had not been given specific reasons for the termination of his service and that no one would talk to him. He appeared angry, indignant and depressed. Mr. Daniell will state that he telephoned the Secretary for the Civil Service, Martin Rowlands who said that he would look into the matter. He will further state that he then questioned the deceased with another Fanling Magistrate, Michael Rattigan present. He will say that the deceased mentioned the fact to him that he had worked in Special Branch previously where he had been investigating homosexuals and that the termination of his services may well have something to do with his work in Special Branch. He did not mention the name of any Police officers. Mr. Daniell then tried to telephone Mr. Purdon to arrange an interview but failed, and as a result he wrote to General Purdon and an interview was arranged. He will state that at some stage the question of going to UMELCO was discussed and so he contacted Father Patrick McGovern who in turn spoke to Mrs. Elsie Elliott. Mrs. Elliott later came up to Fanling to interview the deceased. He will state that whilst all this was going on he knew that Hampton Winter and Glynn were preparing a petition for the Governor.

Some time later the deceased was summoned to Police H.Q. and when he returned he saw Mr. Daniell. He told him that he had seen Mr. Blackburn who had made a statement which Mr. Daniell will state was astonishing. It was "The Governor has intervened and you are to be reinstated and had there been anything in the allegation even the Governor could not have saved you. #1 The deceased also told Mr. Daniell that Mr. Blackburn had said that he would be posted away from Fanling and that when the time came for his promotion he was not to be surprised if he did not go up. Mr. Daniell will state that this remark worried the deceased as it was an indication that his contract would not be renewed at the end of his tour. He will further state that he spoke to the District Police Commander, New Territories, Mr. Illingworth on the telephone about the whole matter and he considered Illingworth to have been unhelpful. He will describe the deceased as a very loyal, straight forward, blunt Scotsman who was not terribly bright and whom he feels has shabbily treated. He will further state that he knows of no one who would wish to frame, the deceased.
