TERMS OF IMMUNITY TO CERTAIN COMMISSION WITNESSES

IN THE MATTER of the Commission of Inquiry into the death of the late Inspector John MacLennan (hereinafter referred to as the "said Commission")

In consideration of your giving a full and truthful statement or statements to the said Commission or the said Commission's representatives, and where lawfully required, your giving oral evidence before the said Commission, I confirm that the Crown will not bring a prosecution against you:
(a) for anything said to Commission representatives relative to this inquiry during the course of interviews;
(b) for all matters referred to in, or directly arising out of, evidence given to the Commission in oral hearing;
(c) for matters constituted by, or arising out of, any conflict between statements previously made to Police officers in connection with inquiries into the death of the late Inspector MacLennan and matters related thereto and statements made to Commission representatives or to the Commission in oral hearing.
It is emphasized and must be understood by you that the above immunities only relate to matters having some genuine connection with the Inquiry into the circumstances surrounding the alleged homosexual acts committed by the later Inspector MacLennan.
