THE IMMIGRATION (AMENDMENT) (NO. 3) BILL

The introduction in 1980 of the requirement for all persons to carry proof of identity, in order to stem the flow of illegal immigrants, has resulted in major scope for profit in the forgery of documents for use as proof of identity.

2. The principal object of the measure under report is to increase, from 7 years to 14 years, the maximum penalty on conviction on indictment for offences relating to forged documents of identity under section 42 of the Immigration Ordinance. This is effected by sections 2 and 3 of the measure.

3. Section 4 of the measure enables the powers of an immigration officer under section 56(1A) of the principal Ordinance to be conferred upon a police officer; provision for this was inadvertently omitted when subsection (1A) was inserted last year.

4. Before the Acting Governor assented to the Bill in the name and on behalf of Her Majesty, the Attorney General advised that he could properly do so.
