Mr John Chan rang from HKGO about Hong Kong Telno 458 to HKGO of 18 March. It refers to FCO Telno Personal No 1 of

16 February to Governor, Grand Cayman, which asked for confirmation that dependencies would be able to enact legislation granting right of abode to 'their' CBDTs.

2. Hong Kong have held up a reply while arguments were going on about the Bill. They still do not favour putting the point to Unofficials until we have a clearer answer on what amendments will be suggested to meet Hong Kong's general complaints. They now ask what is the latest date on which a reply is required. They also have queries on two points of detail:

a) Clause 16(2).

Naturalisation on grounds of marriage. What would be the position if the spouse of a Hong Kong CBDT was already a CBDT with a connection with another territory? Would he or she have right of abode in both places without need for registration?

b) Clause 16(2) requires a spouse still to be married to the

CBDT in question at the time of an application for naturalisation. Is it the case that where someone has been widowed or divorced naturalisation can still be granted under Clause 16(1) through the completion of necessary residence qualifications?

I would be grateful if you would find out the answers to these questions and ring Mr Chan about them.
