NATIONALITY BILL CROWN SERVICE AND HONG KONG UNOFFICIALS

1.

We agreed yesterday that we should confirm with the Home Office that they accept our Legal Adviser's view that 'Crown Service' (without of course the qualification 'under the Government of the United Kingdom') would include members of the Hong Kong Executive and Legislative Councils, and presumably of any similar body in other Territories whose members are appointed by the Crown.

2.

In the telegram which the Chief Clerk sent last night we said that we would seek Ministers' endorsement of this. We need a Home Office view first. I attach a draft letter which I would be very grateful if you would send to the appropriate person if you and Mr Rushford agree.
