However, there is at present a number of declarations under consideration where the above considerations are unlikely to arise, and there is no reason not to accept, the advice of the Antiquities Advisory Board that a declaration should be made. This is because the proposed monuments are on Crown Land, there are no conflicting interests in the future use of the site, and no maintenance or restoration problems.

Consequently it is proposed that the procedures for declaring a monument be simplified. In the future the advice of the Executive Council will be sought in all cases when the proposed monument is on private land, since declaration will affect the property rights of the owner of the private land involved. It is however, proposed that declaration of monuments on Crown Land, where the other considerations described in paragraph 2 above do not arise, will be made by the Governor. The advice of the Executive Council will continue to be sought when these other considerations mean that there may be difficulties in accepting the advice of the Antiquity Advisory Board or when it is proposed that some prominent building be declared a monument even though no difficulties are anticipated.
