Group and assuming a successful outcome of the negotiations on the land exchange proposal involving the depot site it may not however be necessary to resort to resumption proceedings to acquire the land needed by the Corporation for the concourse.

KWG has been informed that it is intended to order the creation of easements over a section of their land at Sharp Street and the Company has said it will not obstruct the proposal. While it would prefer that the creation of the easements should not be ordered it understood why Government considered their creation to be necessary. is not considered that this proposed course of action should prejudice the outcome of the negotiations relating to the exchange of the South Camber site in Canton Road for the Sharp Street tram depot site.

It is recommended that in exercise of the power conferred upon him by section 6 of the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Chapter 276) the Governor should order that easements be created in favour of the Crown over IL 718 and IL 722 as indicated on the plan at Annex A. One month's notice of the creation of the easements is proposed.

Public Reaction

The litigation between KWG and the Wheelock Marden Group has already received limited press coverage. А decision to order the creation of these easements will attract some attention in business circles but is unlikely to be of much interest to the public at large.

A press statement explaining why it is necessary to order the creation of the easements will be issued.

Members will be asked to advise whether the recommendation in paragraph 5 above should be approved.
