It is a requirement of the principal Ordinance that land resumptions and acquisition of easements be proceded by the exhibition of a railway area plan. To meet this requirement within the overall timetable for the construction of the Island Line, the railway area plan for the Island Line must be exhibited by the end of February 1981. However, this can only be done following enactment of the attached bill. It is accordingly proposed to take this bill through Legislative Council in one sitting on the 11th February 1981.

Financial and Staffing Implications

The overall financial and staffing implications of the Island Line for Government were spelt out in XCC(80)137. No additional financial or staffing implications are entailed by the proposed legislation.

Public Reaction

Members were informed in December that adverse reaction might be expected from those whose businesses will be affected by the proposed alignment of the Island Line. Concern will be expressed by those who will have to leave their homes because of railway construction works. Individuals may also be aggrieved at the terms of the compensation offered for their properties.

Publicity

To ensure that no misunderstandings arise a press release to explain the reasons for the amendments will be issued when the bill is gazetted. In addition the staff of the City District Offices will arrange for the proposals to be explained to the public at the district level.

Advice Sought

Members will be asked to advise whether the Mass Transit Railway (Land Resumption and Related Provisions) (Amendment) Bill 1981 should be introduced into the Legislative Council.

(The Mass Transit Adviser designate (Mr C. N. FONG) and Senior Crown Counsel (Mr D. J.G. JONES) will attend before the Council for the discussion of this item).
