Amendment of Streets
(Alteration)
Ordinance and con- sideration of object- ions to and claims in respect of proposed Gloucester Road Flyover and Elevated Road along Connaught Road Central.

Purpose
Principally to revise the period allowed for the submission of claims under the Ordinance from the present two months after gazetting to one-year after the completion of the undertaking and to redefine the scope of claims.
Progress Made & Present Position

a) Drafting instructions have been finalized but their despatch. has been withheld to ascertain whether further amendments would be required in view of the un- certainty over whether certain key definitions in the existing Ordinance, the principal one being "undertaking" would be challenged by, interested parties following a decision taken to degazette and re-gazette certain elevated road projects, aiming primarily to restrict the scope of claims submitted.
b) Two elevated roads on HK Island
have been regazetted so as to include only the ground-level alterations to the existing streets in the "undertaking" in respect of which claims may be made. Objections and claims have been received, relating in the main to the elevated road and making it clear thẻ new form of gazetting will be challenged.
