1. The opinion given by Mr Whitehead seems to be consistent with S17 of the Act of 1870.

2. I should have thought it better for the functions of a police magistrate here to be performed by a magistrate in the DTs also, but this would seem to require legislation under S18 of the Act. NTD might wish to consider whether it is worth encouraging the remaining DTs to legislate in this way where they have not already done so.

3. I attach a copy of SS17 and 18.
