INDEPENDENT COMMISSION AGAINST CORRUPTION (AMENDMENT) BILL
the officer authorized to carry out a search to detain any person found in the premises or place until the search is completed.
6. Clause 5 extends the duty of the Commission to investigate certain offences to include any alleged or suspected conspiracy to commit an offence under the Prevention of Bribery Ordinance and any alleged or suspected offence of blackmail committed by a Crown servant by or through the misuse of office. Both offences are so closely associated with corruption that it is considered necessary for them to be subject to the Commission's duty to investigate.
7. Clause 6 extends the time limit for a prosecution for a summary offence under section 13B ("False reports to officers") and section 13C (“Falsely pretending to be an officer, etc.").
8. Clause 7 creates a new section 17A which establishes a Welfare Fund for the Independent Commission Against Corruption.
9. Clause 8 makes minor amendments to the Independent Commis-
sion Against Corruption (Treatment of Detained Persons) Order.
10. The Bill has no significant financial or staffing implications.
一九八○年總督特派廉政專員公署(修訂)法案
摘要說明
本法案修訂總督特派廉政專員公署條例,以便將拘捕權力擴大至適用於 若干常與貪污有關或常在調查中揭發之罪案,及將該署之工作範圍擴展。本法案又 規定設立福利基金,及根據經驗所需而作若干雜項修訂。
二、 一項與貪污有密切關係之罪名為公務員濫用職權進行勒索。由於兩者 關係密切,當局認為廉政專員公署人員如有合理理由懷疑任何公務員犯有該類勒索 罪, 則毋需令狀亦可加以拘捕。法案第二條(a)款因此將原有條例第十條第(1)款修 訂。
調查貪污罪時,常會揭發其他罪名。目前廉政專員公署人員如有合理理 由懷疑某人犯有另一罪名,而該罪名又為原有條例第十條第(5)款所開列者,則有權將 之拘捕。此等在調查過程中揭發但上述條款未有開列之罪名包括偷竊及製造假賬。 法案第二條(b)款修訂第十條第(5)款,以便加入該兩項罪名,及加入串謀或企圖觸犯 其中一項之罪名。
四、 目前廉政專員公署祇有助理處長或以上人員方有權根據原有條例第十A 條之規定拘留嫌疑犯或准其保釋,而助理處長僅有三人。故法案第三條修訂第十A 條,規定高級廉政主任或以上之人員均可行使上述權力。
五、 法案第四條修訂原有條例內規定有關入屋搜查權力之第十C條,使獲授 權入屋搜查之人員有權將該樓宇或地方內之任何人士拘留,直至搜查完畢為止。
六、 法案第五條將廉政專員公署調查若干罪項之工作範圍擴大,使包括任何 涉嫌或懷疑串謀觸犯防止賄賂條例之罪名,及公務員涉嫌或被懷疑濫用職權進行 索之罪名。該等罪名因與貪污罪有非常密切之關係,故當局認爲廉政專員公署應有 權予以調查。
