Action under CR 55 might therefore meet with general acceptance provided it could be demonstrated that the procedures associated with the tribunal gave the officer a fair hearing.

The use of CR 59 might be less appropriate since it would require modification of the established procedures for dealing with cases under this CR.

Before we take this any further, I would welcome your initial views on this idea of a tribunal, and in particular your views on which Colonial Regulation, 55 or 59, should be applied. These are tricky matters and I suggest that we discuss them later this month.
