GENERAL ADMINISTRATION CIRCULAR NO 15/79
The Prevention of Bribery Ordinance
I feel that at the beginning of a new school year, it is appropriate for me to remind all teaching and non-teaching staff of a school registered under the Education Ordinance that they are, like the employees of any organisation in Hong Kong, subject to Section 9 of the Prevention of Bribery Ordinance.

The section under reference, in simple words, makes it an offence for an employee to accept, without his employer's (ie, the management committee's) permission, an advantage as an inducement to or reward for doing or not doing an act in relation to the employer's business. It, therefore, means that in the case of a school, no staff, teaching or non-teaching, may accept an advantage without the permission of the management committee. Any member of staff, teaching or non- teaching, who wishes to accept an advantage, must consult the school Principal. The Principal may, if so authorised by the school Manage- ment Committee, give permission or refer it to the Supervisor or Management Committee for a decision.

Any allegations or suspicions of corruption in a school should be referred immediately to the I. C.A. C. Complaints about inefficiency or poor management should be referred to the Education Department and not to the I. C. A. C. which is only concerned with corruption.
