Further to our telephone conversation, Mr. Tung appeared before Mr. Justice Stevenson, Mr. Justice Ackner and Mr. Justice Cairns in the Court of Appeal on 23 June. After a lengthy submission to the Court, his Application for leave to Appeal was refused. Mr. Tung said that he would pursue his claim to the House of Lords but is unlikely to have any success there.
