Following encouraging discussions in Peking in June on

13 outstanding British claims against the PRC, Ministers have agreed 14 that a Foreign Compensation Order should be drafted so that these

15 claims can be registered. This is now being put in hand.

16 2.

One consideration which has arisen is that the Chinese might

17 well be reluctant to accept HMG's right to represent the interests

18 of Hong Kong Chinese. We do not want to make an issue of this,

19 and risk prejudicing the chances of making progress on the other

20 claims. But, at the same time, we do not want to seem to be

21 deliberately excluding Hong Kong Chinese from the scope of the

22 Order.

The best (although far from perfect) solution might be that

24 only claims of persons who were CUKCS on 1 October 1949 should

25 be registrable. This would have the effect of excluding the
