Repeal of section 37T.

Section 37T of the principal Ordinance is

repealed.

Addition of Schedule.

5. The principal Ordinance is amended by adding

after section 65 the following -

"SCHEDULE

Vietnam.".

Explanatory Memorandum

Section 18(2) of the principal Ordinance

restricts to a period of 2 months the power of an

immigration officer to remove from Hong Kong a person

who is refused permission to land. In 1979 this was

considered too short a period in the case of persons

from Vietnam particularly in light of the numbers who

were arriving from that country and who would normally

be refused permission to land. Section 18(3) was then

enacted as a temporary measure to exclude the applica-

tion of section 18(2) to persons previously resident

in Vietnam. It is now considered desirable that it

should become part of the permanent law of Hong Kong.

Clause 2 therefore repeals the expiry provision in

section 18(4) of the principal Ordinance. It also

provides that section 18(2) shall not apply to persons

previously resident in any country specified in the

Schedule to the Ordinance (see clause 5). Clause 2
