New section 17K requires employers to keep

records of their employees, and new section 17L gives

labour inspectors and senior labour inspectors power to

inspect the records and also employees' proof of identity.

Penalties are provided for in new section 17M,

and new section 17N creates a presumption that persons

Removal Orders and Appeals

Clause 4 redrafts section 19(1) of the

principal Ordinance so as to transfer to the Director and

Deputy Director of Information the power to make a

removal order, with one exception. The exception is that

the power to make a removal order against a person who is

an undesirable immigrant of less than 3 years residence

remains with the Governor. Clause 4 will also add a new

subsection (5) to section 19, under which a person who is

the subject of an order made by the Director or Deputy

Director must be given written notice of the grounds on

which the order was made and of the time for an appeal

to be lodged.

Clause 5 makes amendments which are in part

consequential upon the redrafting of section 19 of the

principal Ordinance. By new subsection (3A) of section

32, the Director of Immigration will be empowered to

authorize the detention of a person whose removal has been

ordered by the Director or Deputy Director of Immigration.

Clause 7, in conjuction with clause 8, replaces,
