Where a person who is arrested

under subsection (1) is not →

(a) taken before an immigration

officer or immigration assistant

under subsection (3); or

(b) proceeded against for an offence

under section 17C(3),

he shall be released forthwith unless he

is in lawful custody for some other

reason.

Examination

of persons not carrying proof of identity.

17E. Without prejudice to any other

provision of this Ordinance, an immigration

officer or immigration assistant may

examine a person who is found not to have

with him proof of his identity in order to

determine whether that person is committing

or has committed an offence under section

38(1) or section 41.
