Attached at Annex A for the consideration of Members is the Hawker (New Territories) (Amendment) Regulations 1980.

2.

The purpose of this amendment is to seek a further revision of the licence and pitch fees listed in the Third Schedule of the Hawker (New Territories) Regulations with a view to :-

(a) bringing the hawker licence and pitch fees in the

New Territories closer to those applicable in the urban areas; and

(b) reducing the financial deficit incurred by hawker

control in the New Territories.

Background

On 9th August 1977, after considering memorandum XCR(77) 230A (a copy of which is attached at Annex B), which proposed the introduction of new hawker licence and pitch fees in the New Territories in two phases, Members advised and the Governor ordered that the first phase of the fee increases be implemented, subject to:-

"(a) the new fees being rounded off to more convenient

amounts, e.g. $1,000 rather than $1,015; and

(b) the Secretary for the New Territories personally

being satisfied that any adverse reaction to the new fees could be handled satisfactorily; and

that the new fees should be published as a self-contained increase and not as the first phase of a two-stage increase; Executive Council should be asked to advise on the Stage 2 in two years' time."

With the agreement of the Secretary for the New Territories, Phase I of the increases took effect from 1st April 1978. It was accepted throughout the New Territories without demur apart from one or two isolated cases, It is now proposed that a further revision of fees in the New Territories should be implemented on the basis of the schedule of fees set out in Column IV of Annex C. This proposed schedule takes into account the level of fees originally intended for
