(AMENDMENT)(NO. 2) ORDINANCE 1980

This Ordinance amends the Factories and Industrial Undertakings Ordinance to increase the maximum penalties -

(a) that may be provided in regulations

made under section 7 of the Ordinance. The fine of $10,000 is increased to $50,000 (section 2);

(b) that may be imposed under section 11 of

the Ordinance for any contravention or failure to comply with any order made by a magistrate to safeguard against dangerous conditions and practices in industrial undertakings. The fine of $10,000 is increased to a fine of $50,000 and imprisonment for 6 months (section 3).

The increased penalties are designed to impose on employers a greater liability for non-compliance mainly with the safety requirements under the Ordinance and the regulations made thereunder.

Before the Acting Governor assented to the Bill in the name and on behalf of Her Majesty, the Acting Attorney General advised that he could properly do so.
