As part of the exercise to provide for the objects outlined ove, clauses 4 and 5 of this Bill amend the Factories and Industrial Under- takings Ordinance and Regulations to remove the provisions therein relating the general conditions of employment of women and young persons, most of which are contained in Part II of those regulations. It is proposed to replace these provisions by similar regulations to be made under the Employment Ordinance.
Opportunity is taken in clause 2 to remove the references to the employment of children in section 2(3) and (4) of the principal Ordinance; and in clause 4 to delete section 7(2A) which refers to the employment of women and young persons. These matters will be now dealt with under the Employment Ordinance.
Clause 3 effects a minor amendment to section 4(1)(h) of the
principal Ordinance.
The Bill has no financial or staffing implications.
一九八○年工廠暨工業經營(修訂)法案
摘要說明
僱傭條例(香港法例第五十七章)之範圍及作用包括規定工人之一般僱用條件。 根據工廠暨工業經營條例(香港法例第五十九章)制訂之規例,則對婦女及青少年 之一般僱用條件加以規定。由於此兩項法例之目的有所重複,本法案乃對此情况作 合理更改,以便將一切與僱傭有關之社會性措施撥歸僱傭條例處理。至於工作安全 問題則仍屬工廠暨工業經營條例之範圍。
實行上述更改之部份措施,乃以本法案第四及第五條修訂工廠暨工業經營條例 及規例,將其中有關婦女及青少年之一般僱用條件之規定刪去,此等規定大部份載 於該規例之第二部。現建議在僱傭條例制訂相同之規例以替代刪去之規定。
法案第二條將原有條例第二條第(3)及第(4)款內提及僱用兒童之處刪去;法案第 四條則將有關僱用婦女及青少年之原有條例第七條第(2A)款刪去。該等事項將由 僱傭條例加以規定。
法案第三條對原有條例第四條第(1)款(h)段作輕微修訂。
本法案對政府經費及人手需求方面並無影響。
