Minutes of the Extraordinary General Meeting held at Civil Aviation Department Headquarters Conference Room on Friday, 2nd hay 1980 at 9.30 a.m.

The Chairman opened the meeting by remarking that the Extraordinary Meeting had been requested by Hir. Wu in his letter of 18th April 1980, a copy of which had been circulated to all Members. The Chairman then briefly described the format of the background Paper and proposed that the meeting should be directed on three themes, firstly to consider any questions which Members may have on the general background and the Paper itself, secondly general discussion by the Board, thirdly the formulation of any advice or recommendations which the Board might deem appropriate.

General Background

2.1. Mr. u queried the statement at paragraph 10 of the Paper as to how Government were able firstly to submit an appeal under the regulations and secondly to make a submission seeking "direction" under Section 4(3) of the Civil Aviation Act, and whether paragraphs (a) to (f) constituted the submission seeking "direction". He further queried whether in fact Government was simply repeating what it had already submitted. The Chairman confirmed that paragraph 10 of the Paper contained the main points which were to be included in this submission under Section 4(3) of the Act. He stated that as the Hong Kong Government were parties to the original hearings then Government was able to submit an appeal under the regulations, and was also able to submit to the Secretary of State for Trade seeking his direction in the manner now proposed. ir. Taylor noted that paragraph 10 of the Paper before the Board set out in detail some of the points he had mentioned at the Trade and Industry Advisory Board meeting on 14th April 1980, where the CAA decisions had also been discussed.

Mr. Cheong felt that a fundamental question should first be considered by Members. Although he had no doubt that embers were sympathetic to CPA because of the manner of their treatment, he queried whether this issue was within the terms of reference of the Board. To the best of his recollection, a hember at a previous meeting had queried this aspect and he believed that the topic had been ruled out of order by the Chairman. He went on to note that as the Board had not been consulted before licensing applications for the London route he considered that it
