II Pier Leases

In the case of the 11 piers scheduled in Part II of Annex A, it is possible to consider a longer term non-renewable pier lease as they are not affected by known reclamation proposals at present. A lease term of 10 years is considered to be appropriate as it will provide the necessary security of tenure to enable pier lessees to negotiate reasonably long- term contracts for the use of their berthing facilities and to carry out any dredging or maintenance works to the pier foundations or fendering which may be required. However, in order to make allowance for the possibility of future reclamation proposals affecting these piers, the terms and conditions of regrant will include provisions designed to debar lessees from objecting to and claiming compensation in respect of any public works or reclamation in the vicinity of the pier. In so far as the regrant premium is concerned, it is proposed that this should take the form of an annual rental at the rate of $150/m2, subject to review every three years.

Revised terms and conditions for regrant of pier leases

would also provide that, inter alia:-

(a)

On appropriate notice being given, the pier would be surrendered free if required for a public purpose.

No assignment of the pier would be allowed except together with the "parent lot", if there

was one.

(c)

Repairs and maintenance would be at the lessee's own expense.

(d)

The lessee would at his own expense remove the pier on the expiry of the lease at his own expense or its earlier determination if occasioned by his own default.

Members of the Port Committee have been consulted and,

with the exception of the Director of Trade, Industry and Customs, have expressed no objections to the proposals in paragraph 11, 13 and 14 above.
