IMMIGRATION (A MENDMENT) (NO 3) BILL 1979

Introduction
On 10th July, after considering memorandum XCC(79)74,
the Council advised and the Governor ordered:
laws.
(a) that the Immigration (Amendment) (No 3) Bill 1979, at Annex A to the memorandum, should be approved for introduction into the Legislative Council; and
(b)
that the Immigration (Vietnamese Prohibited Immigrants) Order 1979, at Annex B to the memorandum, should be made, subject to the bill being approved by the Legislative Council,

but that further consideration should first be given to some of the terms used in the bill (e. g. "prohibited immigrant", "landing"), to the possible repercussions in other areas of Government activity of making statutory provision for compensation, and to the possible political difficulties of operating outside Hong Kong territorial waters as envisaged.
The Council noted that a further memorandum would be issued accordingly for discussion on 17th July 1979 and that it was proposed to publish the draft bill in the Gazette on 27th July 1979 and then to introduce it into the Legislative Council for all three readings on 1st August 1979, T

The purpose of this memorandum is to consider the issues raised by Honourable Members at the meeting on 10th July.
Terminology i. e. use "prohibited immigrant" and "landing"

This has been reconsidered and "prohibited immigrant" has been replaced in the bill at Annex A with "unauthorised entrant". Also "landing" and "land" have in general been deleted. The explanatory memorandum to the bill has been amended to reflect these changes.
