Introduction

On 28th August 1979 after Members had considered memorandum XCC(79)86, the Council advised and the Governor ordered:

(a) that in the light of the Report at Annex B a further

report should be made on the fields of administration and finance, and powers in relation to them, which the owners of the company would have to concede, ..to enable the Government to have confidence in any understanding it might reach with the Chairman about the appointment and operation of a new and improved management;

(b) that the Attorney General would also advise, in case

the approach in (a) above failed, what was Government's contractual position in relation to the Company's franchise and the powers available under the Ordinance or otherwise to control management, preferably without affecting shareholdings;

(c) that recommendation (h) in paragraph 7 should be accepted

in principle and draft amending legislation should be prepared for further consideration by the Council;

+

(d) that further consideration of recommendations 7(a)-(g)

should be deferred pending the preparation of the report in (a) and the advice in (b) above; and

+

(e) that with regard to recommendation 7(e) there was no

objection to the Commissioner for Transport making informal and non-committal enquiries from those

companies which had expressed an interest in a package of new route s.

The present memorandum concerns (a) above. The Attorney General's opinion is contained in a separate memorandum and Members are also asked to give further consideration to the matters addressed at (d) above.
