Offences and

penalties relating

to

controllers.

Third Schedule.

40. Any controller who contravenes,

or fails, without reasonable excuse, to

comply with a requirement of the Director

under, regulation 10, 11, 12(1), 13(1),

14, 15(1) or (3), 25(2) or 27(1) commits

an offence against that regulation and is

liable to the penalty set out in the 2nd,

3rd and 4th columns of Part II of the

Third Schedule opposite the reference to

that regulation in the 1st column thereof.

Offences and

to owners.

41. Any owner of an aerial ropeway

who contravenes, or fails, without

reasonable excuse, to comply with a

requirement of the Director under,

regulation 6(1) or (3), 8(1) or (3), 16,

17, 20(1), (4) or (5), 26(1) or (2), 27(2),

28, 29(a), (b), (c), (d) or (e), 30, 31(1)

or (2), 37(1) or (2) or 38 commits an

offence against that regulation and is

liable to the penalty set out in the 2nd,

3rd and 4th columns of Part III of the
