his name and address and arrest a person who refuses

to do so (new section 23D(1)). The prescribed penalty

(clause 19) for each of these offences is a fine of

$5,000 and 6 months' imprisonment.

The owner of an aerial ropeway is obliged to

display notices to inform the public of the provisions

of new sections 23A and 23C (new section 23F).

As to (a) above, the new penalties for offences

against the Ordinance are set out in the new Schedule

(clause 19). The principal change is to increase the

penalties for offences by an owner which directly

endanger safety to a fine of $50,000, imprisonment for

2 years, and a daily penalty of $1,000. However, in

the case of offences against sections 18(2) and 19(3)

(closure of ropeways without notification to the

Director) the penalty is reduced to a fine of $5,000.

The maximum penalties which may be prescribed by

regulations are increased by the new section 28(2)

(clause 18) from a fine of $2,000 and imprisonment

for 6 months to a fine of $59,000, imprisonment for

2 years and a daily penalty of $1,000.
