Ref attached, Mr Davidson seems to be saying:

a) the statement on policy towards the dependent

territories should be published;

b) the statement should include a statement to the

to the effect that the perogative of mexey in capital cases should be assumed by the Secretary of State acting after reference to a "Judicial Committee";

c) that BVI Ministers (and Ministers from other dependencies) should be invited to London to discuss the statement before it is published.

I have the following comments on the above:-

a) We agree.

b) No. It has already been decided by the S/S that

Governors must continue to carry this burden

(I assume that Mr Davidson has still not received the recent HKGD letter on the subject).

c) No. Apart from the expense (and in view of b)

above) there is nothing to discuss.
